Terms of Service

These Terms of Service ("Terms") govern the use of the website "YamaQuest" ("the Site") operated by dearstat inc. ("the Company"). By using the Site, you ("the User") agree to be bound by these Terms.

1. Scope of Application

These Terms apply to all content and services provided by the Site. Where separate terms exist for specific features of the Site, such terms shall form part of these Terms.

2. Service Description

The Site is a web media platform providing information about hiking and mountaineering in Japan, in both Japanese and English. Content includes trail guides, route information, spot guides, and travel guides. The Company may change, add, or discontinue services without prior notice.

3. Prohibited Activities

Users shall not engage in any of the following activities:

  • Unauthorized copying, redistribution, distribution, or sale of the Site's content
  • Unauthorized access to the Site or placing excessive load on its servers
  • Interfering with the operation of the Site
  • Infringing the rights of other users or third parties
  • Activities that violate laws, regulations, or public order and morals
  • Any other activities deemed inappropriate by the Company

4. Intellectual Property Rights

  • Hiking and mountaineering take place in natural environments where conditions constantly change. Actions based on information from the Site are taken at the User's own judgment and risk.
  • The Company shall not be liable for any damages arising from the use of information on the Site.
  • Users are responsible for their own safety measures, including submitting climbing notifications, preparing appropriate gear, and checking weather conditions.

Linking to the Site is generally permitted. However, the following links are prohibited:

  • Links intended to defame or disparage the Site's content
  • Links that display the Site within a frame, making it unclear that the content belongs to the Site

The Company assumes no responsibility for the content or services of external sites linked from the Site.

7. Amendments

The Company may amend these Terms as necessary. Amended Terms shall take effect upon publication on the Site. Continued use of the Site after amendment constitutes acceptance of the amended Terms.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes related to the Site shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
